If he leaned well forward to stand up he would likely grip the weapon at a lower point and his weight would be pushing down in the direction of the trigger travel. Still, the rifle almost certainly had a trigger guard and so the trigger should have been protected if his hand slid down.

A more likely scenario to my imagination is that he was a tired old fuck and was holding the rifle in one hand like a pistol and pointing it up as he strained forward to stand and he accidently tightened his grip and fired a burst on automatic. If it was part of a forensic science show the brilliant detective might notice either marks on the floor from recoil if his story is true or the absence of them if it is bs. Or, the floor might be carpeted or the rifle butt padded. Any scenario that I can imagine includes him being an idiot whose idiocy cost another person their life. Manslaughter for sure regardless the truth.

Fri, 26 Jul 2013 18:14:06 +0000 A Guy Called LULU comment 181959 at http://dagblog.com Yeah, the cane possibility http://dagblog.com/comment/181949#comment-181949
In reply to If he was actually using it

Yeah, the cane possibility did occur to me. Still, given his history, I'd still be in favor of more investigating as to whether his story holds water. I'm not sure if it matters much. Either way, it's most likely manslaughter. (I'm assuming he wasn't trying to kill anyone, but I do wonder if he deliberately shot upstairs because he was annoyed by the sound or some such.)

Fri, 26 Jul 2013 17:08:06 +0000 Verified Atheist comment 181949 at http://dagblog.com If he was actually using it http://dagblog.com/comment/181946#comment-181946
In reply to Wouldn't one normally point

If he was actually using it as a crutch, with the stock under his shoulder, Yes. Perhaps he was actually using it as a cane. Maybe mfrs could start marketing crutch ARs for the aging get-off-my-lawn population, and bong ARs for young, white libertarians, AR barbecue tongs for exurbanites, etc.

Fri, 26 Jul 2013 16:58:09 +0000 Donal comment 181946 at http://dagblog.com I'll have to remember that http://dagblog.com/comment/181933#comment-181933
In reply to I saw a good comment at the

I'll have to remember that one the next time I'm having a discussion with my in-laws about the topic…

Fri, 26 Jul 2013 15:11:17 +0000 Verified Atheist comment 181933 at http://dagblog.com I saw a good comment at the http://dagblog.com/comment/181932#comment-181932
In reply to Man using his rifle as a crutch accidentally kills upstairs neighbor, 5: police

I saw a good comment at the NYT on voting, it said Republicans aren't afraid of incompetent nutcases owning an arsenal with no tracking, follow up or real regulation, they are afraid of making it easy for people to vote.

Fri, 26 Jul 2013 15:05:47 +0000 NCD comment 181932 at http://dagblog.com Wouldn't one normally point http://dagblog.com/comment/181930#comment-181930
In reply to Man using his rifle as a crutch accidentally kills upstairs neighbor, 5: police

Wouldn't one normally point the barrel downward if one were using it as a crutch?
