As I understand the issue, Texas has deliberately avoided or quashed reasonable safety measures to the point of overriding the requirements for Tier II reports. Further, the Trump administration had a hand in this as well.

Texas Republicans Helped Chemical Plant That Exploded Lobby Against Safety Rules :

"The French company that says its Houston-area chemical plant is spewing "noxious" smoke — and may explode — successfully pressed federal regulators to delay new regulations designed to improve safety procedures at chemical plants, according to federal records reviewed by International Business Times. The rules, which were set to go into effect this year, were halted by the Trump administration after a furious lobbying campaign by plant owner Arkema and its affiliated trade association, the American Chemistry Council, which represents a chemical industry that has poured tens of millions of dollars into federal elections.

The effort to stop the chemical plant safety rules was backed by top Texas Republican lawmakers, who have received big campaign donations from chemical industry donors."

Trump administration delayed safety rule on chemical hazards after lobbying by Arkema, whose Texas plant exploded:

"EPA Administrator Scott Pruitt prevented the safety rule from taking effect until 2019 to allow the agency time to reconsider industry objections. Chemical companies, including Arkema, argued that the rule could make it easier for terrorists and other criminals to target refineries, chemical plants and other facilities."

One of the stunning things that has come to light is the deliberate exclusion of BASIC PUBLIC SAFETY considerations. No zoning to keep hazardous production and storage away from residential areas and services. No building codes. No fire codes. Removing reporting regulations. These folks aren't having trouble keeping up with a changing environment, they are stuck somewhere before December 29, 1845 (when they became a state).

Guessing most of these specialty chemical companies use either oil or oil by-products, hence their location. I wonder how many of these types of hazardous businesses just naturally spring up next to each other and I'll bet the regulations you're talking about just never caught up (or were fought by now entrenched interests)?
