Excellent points, but I suspect you haven't seen anything, yet.

You are absolutely spot-on in addressing the dog-whistle component in these discussions about the "barren and un-married Ms. Kagan." I believe it is simply laying the groundwork for the cultural warriors to engage mightily against Kagan and the authority of her (in particular) and the Supreme Court to rule on things like DOMA and DADT when these issues inevitably arrive on their doorstep.

I believe I understand all I need to know about Kagan and the talent and experience she brings to the position as Associate Justice. She's certainly well-qualified. But I don't know - and don't care - about her sexual orientation.

But I can predict that the cultural warriors are well-prepared to light their hair afire at the prospect of this supposed lesbian adjudicating the Gay Rights issues. Her sexuality will be made an issue that will stoke the fundraising and stir the base.

That dog whistle? It will become the train whistle on the right-wing runaway locomotive as it runs full tilt into the train wreck that will obliterate anything like civil discourse on important issues. It's what they do. And they do it well.
