Since this provision of the Constitution that the Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it -- Habeas Corpus cannot be suspended unless thee is either a case of Rebellion or Invasion AND the public safety requires it.</p> <p>Note that this does not automatically free the person you are presuming is a terrorist, it just makes the government present its evidence that the individual has done something wrong.
