Unfair, very unfair. First off, Captain Hook sent his orphan thugs to kidnap, not kill, Peter. Second the choke hold used by the orphan thugs is banned by the Code of the Pirate Brethren so Hook is clearly not responsible. And third the orphan thugs got immunity to testify against Hook so can not be prosecuted for the use of a banned choke hold. And lastly, "the code is more what you'd call "guidelines" than actual rules. Welcome aboard the Black Pearl,"
Except for Peter Pan accidentally and inexplicably dying, the way I see it is, no harm, no foul.
