I read this when it came out and it struck me as more being about trying to sue for trademark when you have not trademarked your creation. So in effect it boils down to ye olde "appropriation" issue. People can copy things they like, it's a know thing about humans.

I know with copyrights it's copyrighted when you create it - officially copyrighting it is just to better ensure enforceability, but you can sue without it. Imagine trademarks are the same. (got me to look this up - trademarks are somewhat the same in the US). Good article:
