President Barack Obama’s administration announced Friday that it would stop deporting younger illegal immigrants and would begin granting them work permits.
The policy will apply to immigrants younger than 30 who arrived in the U.S. before the age of 16, have been in the country at least five years, have no criminal history and graduated from high school, earned a GED or served in the military. The decision could affect as many as 800,000 immigrants.
“Our nation’s immigration laws must be enforced in a firm and sensible manner,” Homeland Security Secretary Janet Napolitano said in a statement. “But they are not designed to be blindly enforced without consideration given to the individual circumstances of each case. Nor are they designed to remove productive young people to countries where they may not have lived or even speak the language. Discretion, which is used in so many other areas, is especially justified here.”
Comments
Yay for co-opting Marco Rubio's version of the Dream Act for purely political points after 3 years of ignoring hispanic/immigration advocates and vastly increasing the number of deportations while stating he had to enforce the law, his hands were tied.

"productive young people" - ha, she's making the assumption because they graduated high school they're "productive"
Every 4 years we get a miracle. Ever 4 1/2th year, it disappears.
Of course "served in the military" trumps everything, don't it? Moving sand piles from here to there = "productive". Putting up barbed wire = "productive".
Pounding sand and manning a machine gun = "productive". Unlike working in a pizza joint - then you ain't shit.

Somebody needs to update this, with thanks to Obama.

Yes, between this and his conversion to support for gay marriage, it appears they recognize that they are going to need to take some measures and make some statements the GOP cannot block to get some key constituency groups they are targeting jazzed and energized.
On the jobs and economy issue I am anticipating a debate moment this fall where Romney talks about how he understands the private sector and how to create jobs yada yada and Obama says some pithier, juicier version, consistent with the facts of Romney's record and role at Bain, of "Governor, we've heard lots of talk coming from you and your campaign about how you know how to create jobs. Well, Governor, when it comes to knowing how to destroy American jobs I fully grant that you have much expertise. But the American people don't want jobs destroyed, they want jobs created. What you're proposing has been tried and failed miserably, and I don't think we can afford more job-destroying economic policies."
This might be the best he can do in the absence of offering a positive program of his own that a reputable economist thinks might work.

Now discretion can trump legislatures and the courts?
What's next, jury nullification

"this can have the de facto effect of invalidating the statute."
If the government had done it's job; we wouldn't be in this moral quandary.

Interesting that Al Jazeera English thinks it's a big enough story to headline over goings on elsewhere, like Egypt:
I think Garance Franke-Ruta over @ The Atlantic may have the right take on what's going on, sees a pattern developing:
Game changer is a great description. It's cynical, but so far it does certainly appear like the campaign is studying the polls and seeing which demographics they can grab by throwing a bone without alienating other voters they need. If it's a demographic that they are not going to get anyway, they don't care if they alienate them. Also, if it focuses national news narratives for a couple days away from something to something they'd rather see people discussing, that's a bonus. Also, both things so far are where Obama is drawn as being moderate about the issue, at least to non-wingers (again, he's not after winger votes.)
A little proof of it being a studied campaign choice --just two days ago, I posted this Guardian story in this section:
Deportation of law-abiding immigrants may hurt Obama's re-election chances

Does anyone know, if this change will be impacted by the SCOTUS ruling, to be announced next week on Arizona SB 1070 ?
If this change takes place before, the ruling comes down, does it remain?
If the ruling goes against the Federal government, Obama still comes across as being a moderate and he can say to the Latino community "well at least I tried" ...(only after he caught wind that the SCOTUS ruling wouldn't be favorable)..

Doing this now was definitely was a checkmate against pro-Romney campaign plans; from page 8 of Ryan Lizza's New Yorker article, published for the New Yorker issue on the streets Monday:
But beyond the timing, it wasn't cynical; elsewhere in the article it's made clear by Lizza that immigration reform is one of the main things Obama would like to do in a second term. Also pointed out is that the issue is a bonus for Obama's way of thinking that this is one of the few that still cuts across party lines (even though the article quotes a campaign speech where he admits naivete about bipartisanship, he'd still like to see it happen sometimes.)

So it's really better to continue to continue to hate and bash a president even if he does something you like (because after all, you have him all figured out, and there must be some catch to it?) rather than give positive reinforcement when he does something you like because of political pressure?
Wouldya let me know when we do have that president that is pure, noble, true of heart and all that so I can just sit back and let him handle running the country not have to read the news or anything like that, and a special bonus, political activists can hang up their shingles?
by artappraiser on Sat, 06/16/2012 - 2:56pm

by jollyroger on Sat, 06/16/2012 - 3:25pm
I think you have it backwards. If the only time he does anything positive is when his arm is being twisted, why let up the pressure now? And again, all he did here is act before Rubio could have so it would be his accomplishment (even though legislation would have been a more permanent fix).
It's a long way to November. At this rate with his poor polling and desperation setting in, might get my unicorn any day now. Maybe he should have started soon the right thing 3 1/2 years ago instead of dicking around like the president has no power.
by Anonymous dijamo (not verified) on Sat, 06/16/2012 - 4:22pm
Actually, your comment makes me realize I wasn't that clear about what I was saying--I was was not saying don't arm twist, I was saying I don't like the idea of hating a president so much that you don't think results of arm twisting are real, and that's it worthless to arm twist (hence I mentioned activists giving up.)
It's the flip side of adoration of a president to hate him/her to distraction, and think nothing can be done but get rid of him/her, as I mentioned on another thread the other day. It's just as bad, it's the savior syndrome from either side, no acceptance of politicians as politicians, kinda delusional in light of thousand of years of history.
But then I'm one of those nutty moderates who reads news as well as blog spin, one who in doing so saw evidence that some Bush Derangement syndrome was real, and I do now from time to time see some evidence of Obama derangement syndrome totally removing people from reality on certain points.
by artappraiser on Sat, 06/16/2012 - 4:56pm
LOL at Obama Derangement syndrome. It appears to me that derangement means a departure from reality, whereas my issues with Obama have been on his policy failures and failure to act that are factually based. The reality is we have a desperate candidate with his back to the wall who is willing to do anything to win. What will he do when he wins? Polish his centristy legacy by passing his grand bargain with no opposition from dens. There will be no pressure for that truly lamest of sucks to respond to. So I'll enjoy the pandering for single vote and Obama doing the things he had no power to do for the last 3 1/2 years. I'll let others praise his goodness for the crumbs thrown at their feet (only in election years). He has proven his agenda is that of a fairly moderate republican. I'm voting for the other moderate republican who will face liberal/democratic pressure in his next term: Romney. Too little, too late, too inauthentic, too craven, too pandering to expect any kudos for doing something only because his polling experts tell him to.
by Anonymous dijamo (not verified) on Sat, 06/16/2012 - 8:09pm
LOL.
Like with a moderate Republican in WH, the Democrats are suddenly going to fight like hell...for what?
For progressive values? You really think that?
You really think that, when Romney sends drones into Yemen (your tipping point) the Democrats are going to stand up to him and say, "No, you can't kill those bad guys? You need a FISA court?"
Dijamo, you're a good example of why progressives are always the goat.
by Peter Schwartz on Sat, 06/16/2012 - 8:35pm
Sorry, laughing so hard my finger kept hitting the "save" button.
You know, if you really believed in your little strategy, you'd actually give money and work for Romney.
After all, Romney does have to win for your strategy to work, right? Why hold back, D?
by Peter Schwartz on Sat, 06/16/2012 - 8:39pm
But of course, if he'd gone for legislation, they would've blocked it as they have millions of times before. Including the Dream Act.
But don't worry, you may get to vote for Rubio soon enough.
by Peter Schwartz on Sat, 06/16/2012 - 5:32pm
Am wondering if Romney's bashing Obama for not being a governor before he became president suggest he's privately ruled out choosing Rubio as his running mate?
by AmericanDreamer on Sun, 06/17/2012 - 7:21pm
by jollyroger on Sun, 06/17/2012 - 8:11pm
As I recall, he supported the full Dream Act.
Of course, he didn't huff and puff and blow the walls of Congress down, so there is that to think about before we clap.
